AIOTI Views on the Data Act

AIOTI has made its views on the draft proposal of the dratf proposal of the Regulation on harmonised rules on fair access to and use of data (“Data Act”).

1. Clarifying scope of B2B data sharing provisions
2. Clarifying scope of B2G data sharing provisions
3. Avoiding vendor lock-in while striking the right balance
4. Exclusion of derived data, clearly specified in the definition
5. Promote the cooperation between providers during switching
6. Align data sharing obligations with industrial reality
7. Clarify data sharing requirements on design, manufacturing and mandatory elements to contracts
8. Promoting cross-border data flows
9. Ensuring coherence with the EU regulatory landscape
10. There should be no additional bureaucracy
11. Sufficient protection of intellectual property rights and trade secrets
12. Standardisation should be inclusive and industry-driven
13. Ensure protection for certain databases and confidential business data
